Terms and Conditions

These Terms and Conditions ("Terms") govern the provision of services by RusPost Ltd ("RusPost", "we", "our", or "us"). By booking, using or requesting any of our services, the Customer confirms that they have read, understood and agreed to be bound by these Terms.

Where these Terms conflict with any other document issued by RusPost, these Terms shall prevail unless expressly agreed otherwise in writing.

1. Definitions

For the purposes of these Terms:

Customer means any individual or legal entity purchasing or using RusPost's services.

Sender means the person or organisation dispatching the shipment.

Recipient means the intended receiver of the shipment.

Shipment means any parcel, package, document or goods accepted for transportation.

Goods means the contents of any Shipment.

Carrier means any airline, courier company, freight forwarder, postal operator or other third-party logistics provider engaged by RusPost.

Delivery means transportation of the Shipment from collection to the destination address.

Business Day means any day excluding Saturdays, Sundays and public holidays in England.

Prohibited Goods means goods that may not legally or operationally be transported.

Restricted Goods means goods that may only be transported subject to legal, regulatory or carrier restrictions.

Sanctioned Goods means goods whose export, import, sale or transportation is prohibited or restricted by sanctions or export control legislation.

2. Acceptance of These Terms

By placing an order or delivering a Shipment to RusPost, the Customer confirms that:

  • they are legally entitled to send the Shipment;
  • all information provided is accurate and complete;
  • they have authority to enter into this agreement;

they accept these Terms without reservation.

If the Customer acts on behalf of another person or business, they confirm that they have authority to bind that person or business to these Terms.

3. Our Services

RusPost provides parcel forwarding, international transportation, customs facilitation and related logistics services.

RusPost is not itself an airline, customs authority or postal administration.

Transportation may be performed using one or more independent third-party carriers.

RusPost may subcontract any part of its services without prior notice.

Delivery routes, transit countries, transportation methods and carriers may change where reasonably necessary for operational, legal or security reasons.

RusPost reserves the right to refuse, suspend or cancel any service at its sole discretion.

4. Booking & Payment

All quotations are provided on the basis of information supplied by the Customer.

Shipping charges may change where:

  • weight differs from that declared;
  • dimensions differ from those declared;
  • the destination changes;
  • the contents differ from the declaration;
  • customs classification changes;

additional carrier charges apply.

RusPost may recalculate shipping charges before or after dispatch.

Outstanding balances must be paid immediately upon request.

Where payment is not received, RusPost may suspend transportation until payment has been made.

Unless otherwise agreed in writing, all services must be paid in full before dispatch.

Additional duties, taxes, customs fees, storage charges, carrier surcharges or governmental charges remain the responsibility of the Customer.

Payments already incurred for transportation are generally non-refundable except where required by applicable law.

5. Discounts & Promotions

RusPost may from time to time offer promotional discounts, promotional codes, loyalty rewards or special offers.

Unless expressly stated otherwise:

  • discounts apply only to eligible services;
  • only one promotion may be applied per Shipment;
  • promotions cannot be combined;
  • discounts have no cash value;
  • discounts cannot be exchanged for cash;

promotions cannot be applied retrospectively.

RusPost reserves the right to amend, suspend or withdraw any promotion at any time without prior notice.

Where a booking is amended, cancelled or refunded, any promotional discount may become invalid.

If RusPost reasonably believes that a promotion has been misused, fraudulently obtained or used contrary to these Terms, RusPost may cancel the promotion, recalculate the shipping charges and recover any outstanding balance.

6. Customer Responsibilities

The Customer is solely responsible for ensuring that:

  • all information provided to RusPost is true, complete and accurate;
  • the declared value accurately reflects the contents;
  • customs declarations are complete and accurate;
  • all licences, permits and certificates have been obtained where required;
  • the Goods comply with all applicable laws and regulations;

the Shipment may lawfully be exported, transported and imported.

The Customer shall ensure that no false, misleading or incomplete declaration is made.

The Customer remains solely responsible for any customs duties, taxes, penalties, storage charges, inspection costs or governmental charges relating to the Shipment.

The Customer agrees to indemnify and hold harmless RusPost against all claims, penalties, duties, taxes, losses, legal costs and expenses arising from inaccurate declarations or breach of these Terms.

7. Packaging Requirements

The Customer is solely responsible for ensuring that every Shipment is packed safely and appropriately for international transportation.

Packaging must be capable of withstanding:

  • repeated handling;
  • automated sorting equipment;
  • air transportation;
  • road transportation;
  • warehouse handling;

loading and unloading.

Fragile items must be individually protected using suitable cushioning materials.

RusPost accepts no responsibility for damage arising from:

  • inadequate packaging;
  • insufficient internal protection;
  • weak or damaged boxes;
  • improper sealing;
  • movement of contents inside the package;

unsuitable packaging materials.

If RusPost considers that packaging is unsuitable, RusPost may, at its sole discretion:

  • refuse the Shipment;
  • require repackaging by the Customer;

repackage the Shipment at the Customer's expense.

Acceptance of a Shipment does not constitute confirmation that the packaging is adequate or that the Shipment is suitable for transportation.

8. Prohibited, Restricted, Controlled & Sanctioned Goods

The Customer is solely responsible for ensuring that every Shipment complies with all applicable laws, regulations and import or export requirements in the United Kingdom, all countries of transit and the destination country.

The Customer shall not tender for transportation any Goods that are prohibited, restricted, controlled or otherwise unlawful.

Such Goods include, but are not limited to:

  • firearms, weapons, ammunition and weapon parts;
  • explosives, fireworks and military equipment;
  • military or dual-use goods requiring export authorisation;
  • narcotic drugs, controlled substances and psychoactive substances;
  • hazardous chemicals and dangerous goods;
  • radioactive materials;
  • counterfeit or pirated goods;
  • cash, banknotes, coins, negotiable instruments and securities;
  • bullion, precious metals and unmounted gemstones;
  • live animals;
  • human remains;
  • alcohol where prohibited;
  • tobacco and nicotine products where restricted;
  • prescription medicines requiring authorisation;
  • veterinary medicines;
  • lithium batteries or dangerous goods not accepted by the Carrier;
  • goods prohibited by customs authorities;
  • goods prohibited by UK export control legislation;
  • goods prohibited under the laws of the destination country;

Goods subject to UK, EU, US or any other applicable sanctions or export control restrictions.

The above list is provided for guidance only and is not exhaustive.

RusPost reserves the absolute right, at its sole discretion, to refuse any Shipment whether or not a particular item appears on the above list.

RusPost may also refuse Goods that are considered unsuitable for transportation for operational, commercial, security or reputational reasons.

Acceptance of any Shipment shall not constitute confirmation that its contents are lawful or eligible for transportation.

9. Veterinary, Phytosanitary & Import Controlled Goods

Certain Goods may be subject to veterinary, phytosanitary, sanitary or agricultural import controls.

Such Goods include, but are not limited to:

  • pet food;
  • animal feed;
  • veterinary medicines;
  • meat and meat products;
  • poultry;
  • fish and seafood;
  • dairy products;
  • eggs and egg products;
  • honey;
  • products containing ingredients of animal origin;
  • plants;
  • flowers;
  • seeds;
  • bulbs;
  • soil;
  • timber and untreated wood;
  • fresh fruit;
  • vegetables;
  • agricultural products;
  • biological materials;

any Goods requiring veterinary certificates, phytosanitary certificates, import permits or governmental approval.

The Customer is solely responsible for determining whether any veterinary, phytosanitary, sanitary or import documentation is required.

The Customer shall obtain all licences, certificates, permits and governmental approvals before dispatch.

RusPost does not verify whether such documentation is required and assumes no responsibility for obtaining any permits or certificates.

Where any Shipment is:

  • refused entry;
  • detained;
  • inspected;
  • sampled;
  • quarantined;
  • seized;
  • confiscated;
  • destroyed;
  • returned,

by customs authorities, veterinary authorities, border agencies or any governmental authority, RusPost shall not be liable for any resulting delay, damage, loss or expense.

All inspection fees, storage charges, quarantine costs, disposal costs, customs duties, taxes, return transportation charges and administrative expenses shall be borne entirely by the Customer.

10. Sanctions & Export Controls

RusPost complies with all applicable sanctions legislation, export control laws and customs regulations.

Sanctions and export control restrictions are frequently amended and may change without prior notice.

The Customer is solely responsible for ensuring that every Shipment complies with all applicable sanctions legislation at the time of dispatch.

RusPost does not provide legal advice regarding sanctions or export controls.

Customers should review the latest official legislation before shipping Goods.

RusPost may, at any time and without prior notice:

  • refuse acceptance of any Shipment;
  • suspend transportation;
  • request additional documentation;
  • request proof of end-use or end-user;
  • inspect or scan any Shipment;
  • open any Shipment where permitted by law;
  • repackage any Shipment where necessary;
  • return any Shipment;
  • cancel transportation;

surrender any Shipment to the relevant authorities where required by law.

Acceptance of a Shipment does not constitute confirmation that the Shipment complies with sanctions legislation.

Where sanctions legislation changes after a Shipment has been accepted, RusPost may immediately suspend or terminate transportation without liability.

RusPost shall not be liable for:

  • customs delays;
  • sanctions-related delays;
  • export licence requirements;
  • refusal of export;
  • refusal of import;
  • confiscation;
  • seizure;
  • destruction;
  • governmental action;
  • carrier refusal;

regulatory action.

Where transportation becomes impossible because of sanctions or changes in applicable legislation:

  • shipping charges already incurred shall not be refunded;
  • return transportation shall be at the Customer's expense;
  • storage charges may apply;

customs duties, taxes and administrative fees remain payable by the Customer.

RusPost maintains an internal operational list of Goods that it will not transport.

This internal list may be more restrictive than applicable legislation and may be amended at any time without notice.

RusPost reserves the absolute right to refuse transportation of any Goods which, in its reasonable opinion, present legal, regulatory, operational, commercial or reputational risk.

The Customer agrees to indemnify and hold harmless RusPost Ltd, its directors, officers, employees, agents and subcontractors against all fines, penalties, claims, customs duties, taxes, legal costs, storage charges, return costs, losses and expenses arising from inaccurate declarations or the shipment of prohibited, restricted, controlled or sanctioned Goods.

11. Customs Clearance

The Customer is solely responsible for ensuring that all customs documentation is complete, accurate and truthful.

RusPost acts only as a logistics provider and does not guarantee customs clearance.

The Customer shall provide all information and documentation reasonably requested by RusPost or the customs authorities.

Customs authorities may inspect, delay, open, seize, confiscate or destroy any Shipment without notice.

RusPost has no control over customs procedures and accepts no liability for any customs decision.

The Customer remains solely responsible for:

  • customs duties;
  • import VAT;
  • taxes;
  • brokerage charges;
  • inspection fees;
  • storage charges;
  • penalties;
  • customs fines;
  • import licences;
  • export licences;

any governmental charges.

Any delays caused by customs authorities shall not constitute a breach of these Terms.

Where customs authorities refuse importation, the Shipment may be returned, abandoned or destroyed in accordance with applicable law.

All associated costs shall be payable by the Customer.

12. Delivery

Any delivery dates or transit times provided by RusPost are estimates only and are not guaranteed.

Delivery times may vary depending on:

  • customs clearance;
  • airline schedules;
  • third-party carriers;
  • weather conditions;
  • transport disruptions;
  • government restrictions;
  • sanctions;
  • public holidays;
  • security inspections;

force majeure events.

RusPost shall not be liable for any delay arising from circumstances beyond its reasonable control.

Unless otherwise expressly agreed in writing, time shall not be of the essence in relation to any delivery.

Where delivery cannot be completed due to an incorrect address, failure of the Recipient to accept delivery, customs refusal or any other circumstance beyond RusPost's control, additional transportation, storage or administrative charges may apply.

Risk of loss passes to the Customer or Recipient upon delivery or attempted delivery in accordance with the applicable carrier's procedures.

13. Third-Party Carriers

RusPost uses independent airlines, courier companies, freight forwarders and postal operators to perform all or part of its services.

RusPost shall not be liable for delays, losses or operational decisions made by third-party carriers.

The Customer agrees that the terms and conditions of any Carrier involved in the transportation of the Shipment may also apply.

Where required, RusPost may substitute one Carrier for another without prior notice.

14. Inspection & Security

RusPost reserves the right, where permitted by applicable law, to:

  • inspect;
  • scan;
  • X-ray;
  • weigh;
  • measure;
  • photograph;
  • open;
  • examine; or
  • repackage

any Shipment at any time without prior notice to the Customer.

Such inspections may be carried out for security, customs, regulatory, operational or legal reasons.

If the Customer refuses to permit such inspection, RusPost may refuse transportation or terminate its services.

15. Insurance

Insurance is optional and is only available where expressly purchased and confirmed by RusPost.

Unless otherwise agreed in writing, no Shipment is insured.

Where insurance has been purchased, cover applies only to the total loss of the Shipment, subject to the insurer's policy terms, exclusions and conditions.

Insurance does not cover, including but not limited to:

  • partial loss;
  • cosmetic damage;
  • scratches;
  • dents;
  • scuffs;
  • torn packaging;
  • broken seals;
  • damaged retail packaging;
  • wear and tear;
  • moisture;
  • temperature changes;
  • delays;
  • customs actions;
  • confiscation;
  • seizure;
  • sanctions;
  • prohibited goods;

fragile items unless specifically agreed in writing.

The maximum compensation shall never exceed the declared value accepted by RusPost or the insurer.

Submission of an insurance claim does not guarantee payment.

All claims remain subject to investigation and approval by the insurer where applicable.

16. Fragile Items

Fragile Goods are accepted entirely at the Customer's own risk.

Examples include, but are not limited to:

  • glass;
  • ceramics;
  • porcelain;
  • mirrors;
  • televisions;
  • monitors;
  • computers;
  • electronic displays;
  • artwork;
  • antiques;
  • musical instruments;
  • bottles;
  • collectables;

delicate mechanical items.

RusPost gives no warranty that fragile Goods will arrive undamaged.

RusPost accepts no liability for:

  • breakage;
  • cracking;
  • chipping;
  • bending;
  • crushing;
  • vibration damage;
  • cosmetic damage;

internal component damage.

The Customer remains solely responsible for ensuring appropriate packaging.

17. Returns, Undeliverable Shipments & Disposal

Where a Shipment cannot be delivered, imported or released by customs authorities, RusPost may, at its sole discretion:

  • return the Shipment;
  • store the Shipment;
  • abandon the Shipment;

arrange lawful disposal or destruction.

Return transportation is not guaranteed.

International returns may:

  • take several months;
  • require customs clearance;
  • incur significant transportation costs;

exceed the original shipping price.

All costs relating to:

  • return transportation;
  • customs duties;
  • VAT;
  • storage;
  • quarantine;
  • inspection;
  • destruction;
  • disposal;
  • carrier charges;
  • administrative fees

shall be payable by the Customer.

If the Customer fails to provide instructions or pay applicable charges within a reasonable period specified by RusPost, RusPost may dispose of or abandon the Shipment in accordance with applicable law without liability.

RusPost shall not be liable for any loss resulting from lawful disposal or destruction.

18. Unclaimed Shipments

Where a Shipment remains unclaimed or undeliverable and the Customer cannot be contacted after reasonable attempts, RusPost may:

  • continue charging storage fees;
  • arrange return at the Customer's expense;
  • dispose of the Shipment where legally permitted;

destroy the Shipment where required by law or by the competent authorities.

The Customer shall remain liable for all outstanding charges regardless of whether the Shipment is ultimately delivered, returned or destroyed.

19. Claims Procedure

Any claim relating to a Shipment must be submitted in writing within 7 calendar days of the date of delivery or the date on which delivery should reasonably have occurred.

Failure to submit a claim within this period may result in the claim being rejected.

The Customer must provide all information reasonably requested by RusPost, including but not limited to:

  • tracking number;
  • proof of value;
  • proof of purchase where applicable;
  • photographs of the external packaging;
  • photographs of the internal packaging;
  • photographs of the damaged Goods;
  • any customs documentation;

any other supporting evidence reasonably requested.

RusPost reserves the right to inspect the Goods before considering any claim.

No compensation shall be payable where:

  • sufficient evidence is not provided;
  • the Goods have been disposed of before inspection;
  • the damage resulted from inadequate packaging;
  • the Shipment contained prohibited or restricted Goods;
  • the claim relates solely to delay;

the Shipment was transported without applicable insurance.

20. Limitation of Liability

To the maximum extent permitted by applicable law, RusPost shall not be liable for any:

  • indirect loss;
  • consequential loss;
  • incidental loss;
  • special damages;
  • punitive damages;
  • loss of profit;
  • loss of revenue;
  • loss of business;
  • loss of contracts;
  • loss of opportunity;
  • loss of goodwill;
  • emotional distress;

loss of anticipated savings.

RusPost shall not be liable for any loss, damage, delay or expense arising directly or indirectly from:

  • customs inspections;
  • customs delays;
  • customs duties or taxes;
  • sanctions legislation;
  • export control restrictions;
  • governmental action;
  • seizure or confiscation;
  • destruction of Goods;
  • quarantine;
  • veterinary or phytosanitary controls;
  • acts or omissions of third-party carriers;
  • airline delays;
  • transport disruption;
  • cyber incidents affecting third parties;
  • inaccurate declarations made by the Customer;
  • inadequate packaging;

force majeure events.

Where liability cannot lawfully be excluded, RusPost's total liability shall not exceed the lower of:

  • the declared value accepted by RusPost;
  • the amount actually recovered from the relevant Carrier or insurer;

the amount paid by the Customer for the relevant transportation service.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or any liability which cannot lawfully be excluded under the laws of England and Wales.

21. Force Majeure

RusPost shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control.

Such circumstances include, but are not limited to:

  • war;
  • armed conflict;
  • terrorism;
  • riots;
  • civil unrest;
  • sanctions;
  • embargoes;
  • export restrictions;
  • government action;
  • customs action;
  • strikes;
  • labour disputes;
  • natural disasters;
  • flood;
  • fire;
  • severe weather;
  • epidemic;
  • pandemic;
  • cyber attack;
  • failure of telecommunications;
  • failure of transportation networks;
  • airline cancellations;

acts or omissions of third-party carriers.

Where a Force Majeure Event occurs, RusPost may suspend, delay, modify or cancel transportation without liability.

22. Privacy & Data Protection

RusPost processes personal data in accordance with applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Personal information may be shared where reasonably necessary with:

  • carriers;
  • customs authorities;
  • government agencies;
  • payment providers;
  • insurers;

service providers engaged in the transportation process.

23. Intellectual Property

All content displayed on the RusPost website, including text, graphics, logos, photographs, trademarks and software, is the property of RusPost Ltd or its licensors and is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed or used without prior written permission.

24. Website Availability

RusPost does not guarantee that its website or online services will be uninterrupted, error-free or continuously available.

RusPost may suspend or modify its website or services without prior notice for maintenance, security or operational reasons.

25. Amendments

RusPost reserves the right to amend these Terms at any time.

The latest version shall be published on the RusPost website.

Continued use of RusPost's services after publication of revised Terms constitutes acceptance of the updated Terms.

26. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions shall continue in full force and effect.

27. Waiver

Failure by RusPost to enforce any provision of these Terms shall not constitute a waiver of its rights.

Any waiver shall only be effective if made in writing.

28. Entire Agreement

These Terms, together with the Privacy Policy and any documents expressly incorporated by reference, constitute the entire agreement between RusPost and the Customer concerning the services provided.

They supersede all previous agreements, understandings and representations relating to those services.

29. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or the services provided by RusPost Ltd.
